The man who was killed crossing Layhill Road early Saturday morning in Wheaton had been charged in 2015 with unsafely crossing in the path of a vehicle on the same road.

Montgomery County police identified the man as Alberto Alexander Duque, 30, of an unconfirmed address. Court records state his address was in Silver Spring.

Investigators said Duque was attempting to cross northbound Layhill Road at Greenery Lane when he was hit by a 2013 Toyota Prius.

Duque was taken to a hospital where he died from his injuries.

The driver was identified as a 47-year-old Bowie man.

Duque had been charged on Nov. 18, 2015, for unsafely crossing Layhill Road at Georgia Avenue.

Saturday’s collision was the first fatal pedestrian crash of 2019 after 16 deaths in 2018. The last fatal incident was more than a month ago.

There were more than 300 pedestrian-involved collisions in Montgomery County in 2018. There have been 24 such crashes through Jan. 22 of 2019.

The investigation is ongoing and anyone with information is encouraged to call the Collision Reconstruction Unit at 240-773-6620.
