Intruder who homeowner fatally shot had been sleeping in basement, police say

Authorities say no charges will be filed

Montgomery County police said a man shot and killed by a homeowner in Poolesville Monday morning had been sleeping in the basement “for some time” without the homeowner’s permission.

Police identified the man who was fatally shot as Harry T. Powell, 34, of Washington, D.C.

Authorities said no charges will be filed against the homeowner, who was not publicly identified.

The homeowner shot Powell at around 9 a.m. on Monday, police said in a press release.

Police said the owner of a home in the 18000 block of River Road called emergency dispatchers to report that a man was trying to break into the home. While on the phone with dispatchers, the homeowner shot Powell, killing him, police said.

A police spokesperson could not be reached for comment on Tuesday.
