Montgomery County police charged a Gaithersburg man with murder in the death of a 45-year-old man whose body was found early Tuesday in a Silver Spring apartment.

Wesley Cooper, 46, was also charged with assault and is being held at the Montgomery County Central Processing Unit in Boyds, where he awaits a bond hearing, police said Tuesday afternoon in a statement.

While the statement said Cooper was charged with first-degree murder and second-degree assault, court records indicate the charges were second-degree murder and first-degree assault. Police did not respond Tuesday afternoon to MoCo360’s request for clarification of the charges.

No attorney information for Cooper was available Tuesday in court records.

According to police, officers responded shortly after 1 a.m. to a report of a “fight in progress” in the apartment in the 11400 block of Stewart Lane.

Officers met with Cooper and then found the other man’s body inside the apartment, the statement said. The man’s identity will be released following notification of next of kin, police said.

The man’s body was transported to the Office of the Chief Medical Examiner in Baltimore for an autopsy to determine the cause and manner of death, the statement said.
