A former Montgomery County Public Schools employee accused of sexually touching a 10-year-old girl has been indicted on charges of second-degree assault and fourth-degree sex offense.
Roy “Andy” Simmons III, 41, was indicted by a Montgomery County Circuit Court grand jury, according to court filings posted Friday
He was arrested in October in connection with an incident that allegedly occurred in November 2016 at Carderock Springs Elementary School in Potomac.
While a group leader for an outside company, Kid Adventures, at an after-school event, Simmons allegedly hugged the female student from behind and rubbed her chest. The girl, who is now 11, spoke to police in May 2017, telling them she was “very uncomfortable” and that Simmons apologized to her the next day.
When police interviewed him in June, Simmons said the girl had been “kind of flirting” with him, according to court documents. Detectives asked if he was sorry for touching her chest and he said, “Yes,” police wrote in charging documents.
Simmons also worked as a part-time paraeducator at Carderock Springs, but the school fired him in May after learning of the allegations. In court filings, Simmons reported that he had worked at Kids Adventures for six years.
Simmons, a Gaithersburg resident, was released in October on $15,000 bail. His attorney was not immediately available for comment Monday.
Simmons’ next schedule court date is a Feb. 2 hearing in Circuit Court.
