Dave & Buster’s appealing White Flint Mall lawsuit

The arcade and restaurant formerly located at White Flint Mall isn’t retreating from its battle with the mall’s owners. Dave & Buster’s has appealed a federal court ruling issued in July that forced the business to vacate its mall location, according to a report published in the Washington Business Journal Tuesday. A judge ruled the arcade violated its lease with the mall by opening another location at Arundel Mills in Hanover, Maryland. However, the arcade plans to argue this time that the statute of limitations had expired regarding the lease violation and that the mall’s owners—Lerner Enterprises and The Tower Companies—wanted Dave & Buster’s out of the mall so they could redevelop the site, according to the news report.

The mall’s owners are also involved in two other major cases regarding the mall—one involving Lord & Taylor over the retailer’s lease with the mall and the other involving Lawrence Lerner—that recently became intertwined. Lawrence Lerner is the brother of Lerner Enterprises founder Ted Lerner. He filed a lawsuit regarding his ownership stake in the mall.

Hadlee, a boutique from the owners of Bethesda’s Sequel and Wear It Well fashion stores, is opening a store at The Shops at Wildwood in Bethesda, according to photos posted by Bethesda blogger Robert Dyer.

The retail store will be at 10303 Old Georgetown Road and the company’s Facebook page says it plans to open sometime in March. The space is the former location of the fashion boutique Madeline, which operated at the shopping center for 24 years before closing in November.

Report: Establishing White Flint Urban District could be challenging

A new county Office of Legislative Oversight report released this week finds that it may be difficult to fund an urban district—an entity similar to the Bethesda Urban Partnership—in the developing portion of White Flint, recently coined the Pike District. The reason, according to the report, is that the Pike District doesn’t have county-owned parking lots or an urban district tax to help fund the kind of programs such as beautification, trash management and festivals that are run by an organization like the Bethesda Urban Partnership.
