Driver Charged in Fatal Darnestown Road Bicycle Collision

60-year-old bicyclist killed in November collision near Quince Orchard High School

The driver of a truck who struck and killed a bicyclist in November at the entrance of a shopping center near the Gaithersburg and North Potomac line has been charged with two driving offenses.

County police announced Wednesday that the driver, John Phillip Kline, 52, of Hagerstown was charged Feb. 5 with failure to yield to oncoming traffic on a left turn and negligent driving.

Police said Kline was traveling west on Darnestown Road around 9:45 a.m. on Nov. 24 when he made a left turn on a green light into the Shops at Potomac Valley shopping center and struck a bicyclist, who later died from his injuries. The cyclist was traveling east on Darnestown Road in the far right lane when he was struck, police said. Police spokesman Capt. Paul Starks said in November, shortly after the collision, that the green light was not a green arrow.

Police identified the bicyclist as Andrew Gerard Malizio, 60, of Gaithersburg.

At the time of the accident, Kline, a Washington Suburban Sanitary Commission employee, was driving a WSSC-owned Ford F550 truck. The truck struck Malizio near the entrance of the shopping center, according to police. Rescue workers attempted to save Malizio, but he died from his injuries at the scene, police said.
